PRIVACY POLICY

This Privacy Policy is in full compliance with the new EU regulations on general data protection and protection of private data (GDPR), in effect by 25 May 2018.

This Privacy Policy defines the way in which the website LAYERSTOCK.COM, owned by the ART I.K.S. non-profit association for supporting and developing freedom of expression and development of artistic expression (henceforth referred to as The Site) manages data and information received while visiting The Site, registering, and using The Site.  These rules apply to all private data collected by The Site.

By visiting The Site, users agree that The Site has the authority to collect and use all the private data of the user in line with the latest update to the Privacy Policy posted by The Site. The Site encourages visitors and users to regularly review the updates to the Privacy Policy.

At any time the Site's users may allow or forbid the the collection and use of private data by The Site at will.

 

 

  1. DATA COLLECTION

As is the case with most websites, during the use of The Site, certain non-private data may be collected automatically, such as type of browser, operating system, IP address, language version, as well as navigation information: time spent on the website, the pages of The Site visited, and actions taken while using The Site.

If The Site is accessed using certain mobile applications and services, non-private information is automatically gathered about the mobile device; however, The Site does not solicit, access, or trace any information in time regarding location, movement, or other activities involving the mobile device.

The Site will never solicit information regarding race, ethnicity, religion, health, sex life, biometric, or genetic data.

The Site forbids conveying private data to a person other than the owner of that data.

The Site does not solicit private information from visitors, but by registering as a User of The Site, The Site requests certain private information needed for using The Site. This private data is gathered by The Site on a voluntary basis, granting The Site the right to collect and use this private data in line with the End User Agreement between User and The Site and the standing Privacy Policy.

General private information:

-        Personal information while registering with The Site, such as username (login), full name, telephone and fax number, mailing address, e-mail address, and password used to access The Site.

Private data used to purchase Layerstock products:

-        billing information, such as credit card number, expiration date, type, and billing address;

-        business information, such as name and type of company, title and job description for the person delegated to purchase products from The Site;

Private data of Contributors to Layerstock services:

-        information supplied by the Contributor for due payment, such as data on method of payment, e-mail for payment, information on the personal account with a financial institution used for payments;

-        information supplied by the Contributor for personal identification, such as the copy of a piece of ID issued by the state to which the Contributor belongs.

Private data, as well as personal identity data, will be stored securely on The Site's servers; credit card numbers shall not be stored.

Each User may control at will personal information published on the Profile page.

Depending on their activity, each User has the right to refuse at any time the conveyance of private data; however, by refusing to convey private data necessary for using The Site, the User renounces the right to use The Site.

 

  1. USE OF PRIVATE DATA

The collection and use of user private data is done for the purpose of using and improving the services of The Site, and in order to comply with legal obligations.

The Site collects and uses private data for the following purposes:

-        creating and managing accounts;

-        providing technical assistance in relation to information requests as part of The Site's activities;

-        customer service;

-        payment of commission to Contributors;

-        confirmations for orders, purchases, payment, and billing;

-        data analysis for the purpose of improving products, services, and technology offered by The Site;

-        maintenance of interactive areas;

-        new product and services notifications;

-        investigations, prevention, and measure taking regarding illegal copyright-related activities;

-        investigations, prevention, and measure taking regarding violation of the End User Agreement.

The Site shall not sell, rent, disclose, or transmit private data belonging to third parties, with the exceptions described in this Privacy Policy.

The Site only collects private data provided voluntarily by users, and does not solicit users private information belonging to third parties.

Private data may be collected and used by The Site in states other than the one the user belongs to. By using The Site, the user agrees to transfer private data to a territory other than the one they belong to, limiting the collection and use of private data strictly for the use of The Site, accepting the fact that privacy laws in other countries may be different from the ones that apply in the country the user belongs to.

User private data may be disclosed and distributed to partner entities that offer common services in the relationship between the User and The Site, such as bank transfers, payment processing, billing, etc. These third parties will receive only the information necessary to supply said services. This information will be stored and protected in line with The Site's principles of confidentiality, and cannot be used for any other purposes.

In case The Site is acquired, bought, or is subject to merger, the user's private data may be disclosed and transmitted to business entities in line with procedures mutually agreed to by the parties. In this case, The Site will inform users on the procedures that apply.

Under certain conditions, The Site may be constrained to disclose user private data in response to legal demands from public authorities. In these judicial cases, The Site may disclose user private data to the proper authorities in order to protect the rights and safety of users and/ or other persons, in order to avoid litigation, in order to investigate fraud, to protect national security, in order to enforce the law, or for other judicial or public matters.

Users may choose to subscribe or unsubscribe for promotional communication and advertising sent by The Site; however, this does not apply to messaging and communication that are obligatory for the functioning of The Site. In order to opt out of messaging and communication that are obligatory for the functioning of The Site, the user must deactivate their account.

Before using private data for reasons other than those described in the present Privacy Policy, The Site must ask for the user's consent.

 

  1. ACCESS TO ONE'S OWN PRIVATE DATA

Users can access their own public private data in the Profile section.

For security reasons, certain public private data may be restricted by The Site.

Also for security reasons, certain private data may be modified only by contacting The Site's assistance, at support@layerstock.com. The Site shall answer requests in a timely fashion.

Upon request, The Site may provide users with a copy of collected private data. These requests may be submitted to support@layerstock.com, and The Site shall answer them as soon as possible.

 

  1. DATA STORAGE

The Site shall store the users' private data as long as their accounts are active, or as needed for the correct and proper functioning of The Site, including from a legal point of view.

In order to cancel their account, users must contact The Site and fill in a request for account canceling, deletion of data, or ban on using their private data for services, using the address support@layerstock.com. The Site shall answer within a maximum of 30 working days.

The Site reserves the right to store and use private data of deactivated users only for the purpose of compliance with the law, litigation settlements, fraud prevention, or the enforcement of standing agreements.

 

  1. INFORMATION EXCHANGE WITH SUPPLIERS OF SERVICES

The Site uses one or more external companies to process credit cards in order to bill services on behalf of The Site. As far as The Site is concerned, these companies do not keep, store, use, or share such private data except for the purposes of their business.

As a start-up, The Site as of yet has no ties and contracts with entities to offer services on The Site's behalf. In case such ties and contracts occur, The Site takes on the obligation to convey to these entities only the private data needed to enable the provision of services. The Site takes on the obligation to request contractually of any company with whom it shares private data to protect said data in a way that is compatible with The Site's Confidentiality Policy, and to limit the use of private data only in order to increase the quality of The Site's data.

When The Site creates ties and contracts with other entities to offer services on behalf of The Site, the users of The Site may be informed of these entities through a new Confidentiality Policy posted on The Site.

The Site shall not sell or provide other companies private user data for the purpose of selling its own products and services.

 

  1. PROTECTING PRIVATE USER DATA

Private data supplied by users for the purpose of using The Site are strictly monitored by The Site in several ways:

The users' account and private information are protected by the password selected by each user. Using a strong password kept secret is the responsibility of the user.

The Site is making all efforts to protect private data during the collection, storage, and transfer of this information in electronic format. However, there is no perfectly safe method to transfer data through the Internet, or to store data. For this reason, The Site cannot offer an absolute guarantee of private data safety.

Users have the right to file complaints with the relevant authorities in their countries of residence in case they believe their right to confidentiality has been violated by The Site.

  1. COOKIES AND OTHER TRACKING TECHNOLOGY

The Site and its partners may use cookies and other such technology in order to analyze development trends, in order to improve The Site's services and management, in order to follow the movements of the users within The Site, and in order to collect demographic data on The Site's database in general.

For most browsers, cookies can be managed individually. The browser may be set to accept or reject certain websites installing cookies. For more information on cookies you may consult the following websites: www.youronlinechoices.eu; www.aboutads.info; www.youradchoices.ca.

In certain cases, rejecting cookies may impede the user's ability to use The Site.

As a start-up, The Site has no ties and contracts with third parties to offer advertising services on The Site, or to manage advertising on other websites. When The Site will establish durable ties and contracts, The Site shall not be obligated to provide its partners private user data, the partners of The Site shall be able to use cookies and web trackers to collect non-private data on the activities carried out by users on The Site, as well as on other websites visited and/ or used by the users, in order to offer targeted advertising to users.

When The Site establishes contracts with third parties to offer advertising services on behalf of The Site, the users of The Site may get informed on these entities through a new Confidentiality Policy posted on The Site, including the possibility of opting out of advertising. However, opting out of advertising does not stop the distribution of  advertising. Users may continue receiving generic advertising messaging.

 

  1. LINKS TO OTHER WEBSITES

In some cases, The Site may link to other websites. The Confidentiality Policies of those websites may be different from the Confidentiality Policy of The Site. Before sending private data to other websites, The Site encourages users to read closely the confidentiality policies of said websites.

 

  1. WIDGETS AND SOCIAL MEDIA ACCOUNTS

The Site may include social media inserts such as Facebook, Twitter, Instagram, widgets, and other sharing buttons. These services may collect information on the IP address, visualizations on The Site, ask for the user's name, e-mail address, generate cookies in order to allow proper social media functioning. The users' interaction with these functions is regulated by the confidentiality policy of the companies providing said services.

 

  1. PRIVATE DATA OF MINORS

The company's content and services are not aimed at people below 18 years of age. People below the age of 18 are not allowed to submit private data, open an account and/ or use the services of The Site.

The Site does not intend to collect and use private data of persons below the age of 18, and does not intend to use or disclose knowingly any information obtained from people below 18 years of age.

If a third party notices that a person below the age of 18 has provided private data or has opened an account, that third party is obligated to inform The Site as soon as possible, using the e-mail address support@layerstock.com. Private data submitted by a minor, as well as the data associated with it, shall be deleted from The Site's database.

The Site's users assume responsibility for declaring they are older than 18 years of age, with all the resources and legal rights for using The Site, and are able to bear any legal responsibility deriving from using The Site.

 

  1. BLOGS, FORUMS, AND ON-LINE COMMUNITIES

The Site may offer users links and profile creation on its blog or on-line forum. Users should be aware that any private data shared with on-line communities may become available for collection and use by other people with access to those communities. The Site has no control over the actions of people that users choose to come into contact with. In order to request the removal of private data from The Site's on-line communities, users are directed to e-mail support@layerstock.com. In some cases, if the blogs, forums, and on-line communities are managed by third parties, users have to connect to the specific application or contact the third party in order to have private data posted in the comment section removed.

 

      12. CHANGES TO THE CONFIDENTIALITY POLICY

The Site reserves the right to update from time to time its confidentiality policy in order to bring it up to date with new standards and practices. Before changes to The Site come into effect, the users shall be informed of the new Confidentiality Policy by e-mail or on The Site's home page. The Site encourages users to periodically consult The Site's Confidentiality Policy in order to keep up to date with The Site's confidentiality practices.

 

  1. CONTACTING THE SITE REGARDINGN ITS CONFIDENTIALITY POLICY

The Site makes considerable efforts, out of a deep concern, with regard to the right of every user to protect their privacy and their private data. For this reason, any question or suggestion regarding The Site's Confidentiality Policy are kindly directed to contact The Site writing to support@layerstock.com, providing as much detail as possible if complaining that The Site violated their rights while collecting and using their private data.
